Candidate – Terms and Conditions of Business
- Acceptance of Terms and Conditions
A Candidate is considered to have accepted these Terms and Conditions upon submitting their CV to Children’s Home Recruitment Ltd via email at [email protected], registering on our website at www.childrenshomerecruitment.com, or when Children’s Home Recruitment Ltd starts providing Recruitment Services to the Candidate.
- Definitions In these Terms and Conditions, the following terms apply:
- Affiliate: Any entity controlling, controlled by, or under common control with a Party.
- Agreement: This document containing these Terms and Conditions.
- Candidate: Any individual who contacts or is contacted by Children’s Home Recruitment Ltd for job opportunities.
- Client: Any entity or individual seeking to employ or engage a Candidate through Children’s Home Recruitment Ltd.
- Control: Ownership of over 50% of voting or profit rights in an entity.
- Data Protection Legislation: Legislation related to data protection, including the GDPR and its successors.
- Engage: Employment, hiring, or use of a Candidate by a Client in any capacity.
- Introduce: Providing a Candidate’s details to a Client.
- Children’s Home Recruitment Ltd: Registered company in England and Wales, registration number 16039983, located at 32 Queens Road, Reading, RG1 4AU.
- Party: Refers to Children’s Home Recruitment Ltd or the Candidate.
- Recruitment Services: Services provided by Children’s Home Recruitment Ltd to assist in job placement.
- Recruitment Services
- Children’s Home Recruitment Ltd offers Recruitment Services as per this Agreement.
- These services are provided to Candidates at no cost, with fees potentially charged to Clients.
- There is no guarantee that Children’s Home Recruitment Ltd will secure a position for the Candidate or forward their details if deemed unsuitable.
- Children’s Home Recruitment Ltd can edit CVs for errors and redact personal data before submission.
- Neither Children’s Home Recruitment Ltd nor the Client covers interview-related expenses unless agreed otherwise.
- Candidate Obligations
- The Candidate must provide:
- An accurate CV.
- Copies of qualifications and professional memberships if requested.
- Full and accurate information for any online applications.
- By submitting a CV, the Candidate:
- Authorizes Children’s Home Recruitment Ltd to act on their behalf in recruitment.
- Consents to sharing their CV with Clients.
- The Candidate must inform Children’s Home Recruitment Ltd immediately upon accepting an offer or starting an engagement with a Client.
- On request, the Candidate must provide contact details of at least two referees.
- The Candidate should notify Children’s Home Recruitment Ltd of any issues that might negatively impact the engagement.
- The Candidate must not engage in behaviour detrimental to the reputation of Children’s Home Recruitment Ltd or its Clients.
- Data Protection
- Children’s Home Recruitment Ltd complies with Data Protection Legislation.
- For details on how personal data is used, our Privacy Policy can be accessed on request.
- Warranties, Liability, and Indemnities
- The Client is responsible for reviewing CVs, shortlisting, and making job offers.
- Children’s Home Recruitment Ltd does not guarantee job suitability; Candidates must assess this themselves.
- Liability of Children’s Home Recruitment Ltd is limited to direct results of their negligence; they are not responsible for indirect losses or Client-related issues.
- Indirect and consequential damages are not covered by Children’s Home Recruitment Ltd.
- The liability cap is the fee paid by Clients for the Candidate’s introduction, with no exceptions.
- General
- Interpretation rules for this Agreement include gender and number neutrality, and references to law including amendments.
- Either Party can terminate with 14 days written notice.
- Amendments require written consent from either Parties.
- Rights and obligations under this Agreement cannot be transferred without consent.
- This Agreement is the full understanding between Parties, excluding prior agreements except for fraud.
- No partnership or agency relationship is implied beyond contractual terms.
- If any part is unenforceable, it will be severed without affecting the rest.
- Third parties have no enforcement rights under this Agreement.
- Notices must be sent through email correspondence.
- Applicable Law and Jurisdiction
- This Agreement is governed by English law, with exclusive jurisdiction in English courts.
